Robert Mecrate-Butcher, employment partner at law firm Pinsent Masons, warns that PR agencies and clients alike should heed the recent unfair dismissal win by PRO Karis Hunt (PRWeek, 6 July) as a warning sign for the industry.
In this week’s video podcast Mecrate-Butcher summarises the consequences of TUPE, the recently amended Transfer of Undertakings (Protection of Employment), which allows PROs to transfer to a rival firm following a re-tender.
He says TUPE ‘gives the message that on tendering of accounts, staff can transfer from one agency to another regardless of whether or not agencies intend that to happen’.
