PRCA offers helping hand to agencies afraid of idea theft

The PRCA has moved to address concerns from agencies that ideas they present during pitches may be appropriated by clients if they do not win the contest.

It has worked with its legal partner Lewis Silkin to draw up a pre-pitch agreement template allowing agencies and freelancers to secure agreement from potential clients that they retain intellectual property rights to their pitch ideas.

In addition, the two parties have drawn up a confidentiality agreement template committing agencies to ensuring that commercially sensitive client information is secure.

PRCA director-general Francis Ingham said: "I have heard anecdotally from our consultancy membership that on some occasions when they have not won a pitch, they have subsequently seen their big ideas being used by the company to whom they pitched.

"Ideas are the result of substantial time, effort and resources of consultancies. Therefore, it is only fair that these ideas are their property. The documents are beneficial to both sides - creating certainty and confidence for the industry."

The move follows the PRCA’s launch of its Pitching for New Business offering last week.
