LONDON (Brand Republic) – The German Supreme Court has overturned a five-year ban on controversial Benetton ads featuring Aids victims and ecological disasters, after ruling that free speech had been violated by the ban.
The ads had originally been banned by Germany’s federal appeals court in 1995. It ruled the fashion ads were morally offensive and violated the principles of fair competition by using compassion for commercial purposes.
The ads had previously appeared in a German magazine Stern before an advertising watchdog filed a complaint and they were banned. The magazine’s publisher Gruner & Jahr appealed, but the Italian clothing company did not.
