NEW YORK: Medialink and KD Paine %26 Partners reached a mutual, out-of-court agreement on July 1, stating that the latter's website (measuresofsuccess.com), newsletter (The Measurement Standard), and personalized measurement services (Dashboard Development) could resume operation.
Last month, the company was ordered to temporarily shut down when Medialink filed a lawsuit against president Katie Paine, founder of Medialink's research division Delahaye Medialink. Upon leaving the company, Paine's contract prohibited her from entering any business arrangements that would directly compete with her previous firm.
"The critical element was in defining Paine's targeting and offerings," said Mark Weiner, CEO of Delahaye Medialink, "and now we are more clear on that. The key stipulation leading to the mutual agreement is that KD Paine will only offer research and consulting services to small and nonprofit organizations with PR budgets under $100,000.
Additionally, Paine said her company's services differ in nature from those of Delahaye Medialink. "My focus is more on helping people find their measures of success, as opposed to actually conducting the research for them, she said.
